Law 25

This Personal Information Protection and Confidentiality Policy (hereinafter referred to as “the Policy”) has been developed in accordance with the requirements set out in Law 25 in Quebec and aims to explain how the company owner (“U WAGEN”) of the website uwagen.com (“the Website”) collects, uses, stores, discloses, destroys and protects the personal information of its users, customers and visitors. U WAGEN is committed to respecting the confidentiality and security of personal information in accordance with applicable legislation.

Background

U WAGEN is a company that processes personal information as part of its commercial activities in Quebec.
This policy concerns visitors to the Website (“the User”) and customers of U WAGEN (“the Customer”).

Acceptance of this policy

By using U WAGEN’s products, services and/or Website, the User and Customer consent to the collection and use of their personal information in accordance with the policies set forth in this document.

In the event of non-acceptance of the policies stipulated in this contract, the User must renounce access to the services offered by the Website, and the Client to the services in general offered by U WAGEN.

U WAGEN reserves the right to unilaterally modify the content of this Policy at any time; This Policy has specific conditions that relate only to the protection of personal information, the Privacy Policy, and the technologies used to manage this information. Application and definitions

This Policy applies to U WAGEN, including its officers, employees, consultants, subcontractors, as well as any person who otherwise provides services on behalf of U WAGEN. It also applies to the Website, as well as all websites controlled and maintained by U WAGEN.

It covers all types of personal information managed by U WAGEN, whether it is the information of its clients, potential or current, its consultants, its employees, its members or any other persons (such as Users of the Website or other).

For the purposes of this document, personal information is information which concerns a natural person and which allows, directly or indirectly, to identify them.

Consent

Through its Website, U WAGEN may collect some personal information concerning the User with their consent. This consent is obtained implicitly when the person decides to continue browsing the Website after having been informed by this Policy.

The User can:– choose to accept the conditions listed in the Privacy Policy, as well as in the Terms and Conditions, and enter the Website; – choose which cookie files to accept (or refuse), and enter the Website; – refuse all cookie files, except those necessary for the proper functioning of the Website, and enter the Website.

Internally, U WAGEN collects personal information directly from the person concerned and with their consent. This Policy and the information it contains may be accessed by that individual at the time personal information is collected.

Collection of personal information

on the Website
Optional cookie files when entering the site, the information collected is anonymized (i.e. it does not allow the User to be identified) and used for statistical purposes and performance only (for example, to measure Website traffic). The User can choose not to be tracked by optional cookies by personalizing their preferences or by clicking on I refuse when entering the Website.

U WAGEN may collect personal information concerning the User through its Website, for example, through the contact form, voluntarily completed by the User. This information may include, but is not limited to, name, email, telephone number, and other data as necessary to provide the Services.

If the User wishes to receive the U WAGEN newsletter, the mailing list subscription form asks for the email address. This information is maintained by MailChimp, a company now owned by Intuit , and which is governed by its own privacy policies and terms . Consult the terms and conditions of the newsletter .

Internally

U WAGEN collects more sensitive personal information internally only, by the following means: In person, at the U WAGEN establishment (verbally or by forms); by telephone; by email (directly or via an attached document or other type of form); by deposit of documents by the client in an “electronic content vault”.

For what information is specifically collected, and the means by which it is collected, see Appendix A.

Please note that U WAGEN’s services and programs are not aimed at minors, and more generally, U WAGEN does not intentionally obtain personal information about minors.

Use of personal information

on the Website

The User’s cookies are used exclusively by U WAGEN in order to respond to the User’s requests, to personalize their browsing experience on the Website (for example, for the choice of language), to improve the products and services offered, and to comply with legal obligations.

In certain cases provided for by law, U WAGEN may use information for secondary purposes without the User’s consent, for example:

  • when this use is clearly for the benefit of the User;
  • when necessary to prevent or detect fraud;
  • when necessary to evaluate or improve protection and security measures.
Internally, the use of personal information is limited to employees for whom this information is necessary to carry out their duties.

Disclosure of personal information

U WAGEN does not disclose the User’s personal information to third parties.

Internally, a confidentiality and non-disclosure agreement is signed with employees, interns and self-employed workers who may have access to personal information.

In the event that service providers, commercial partners or legal authorities may have access to certain personal information during their provision of services, U WAGEN ensures that these third parties respect the confidentiality and security of the User’s information. with a confidentiality and non-disclosure agreement (see the Use of Personal Information section).

Preservation and destruction of personal information

on the Website

U WAGEN does not store personal information directly on the Website or in a database linked to the Website.

Accepted cookies are only retained for statistical reporting purposes, and are stored through third parties (e.g. Google) and not on the Website.
Internally

U WAGEN will only retain personal information for as long as necessary to achieve the purposes for which it was collected.

The retention period for files is 5 years. The destruction of expired personal information by U WAGEN will be done securely every year, to ensure the protection of this information.

Responsabilities of U WAGEN

U WAGEN is responsible for the protection of the personal information that it obtains through its Website and that it keeps in its establishment.

The person responsible for the protection of personal information at U WAGEN is responsible for ensuring compliance with applicable legislation regarding the protection of personal information.

U WAGEN staff members having access to personal information or being otherwise involved in its management must ensure its protection and comply with this Policy.

Website user responsabilities

To benefit from maximum security, the User should:
  • use the most recent version of a browser that meets security requirements (SSL protocol with 128-bit encryption);
  • clear computer’s cache after transmitting data;
  • keep the identification data, access code and password confidential (The Website cannot under any circumstances be held responsible for unauthorized use of these. If their confidentiality were to be compromised, please notify U WAGEN immediately to avoid fraudulent use of identity.)

Security of personal information

U WAGEN implements appropriate security measures to protect the User’s personal information against unauthorized access, misuse, disclosure or alteration.

For the Website, the security protocol it uses, SSL (Secure Socket Layers ), makes it possible to transform the information entered into encrypted information (128-bit encryption) and to verify the identity of the parties (the user and the site) who communicate together via the Internet.
Generally, secure pages are identified using the [padlock] symbol which appears to the left of the site URL in the browser. This symbol ensures that the transmission of information provided by the user is encrypted.

U WAGEN reminds the User that the transmission of information by email is not completely secure. This is why it is not recommended to disclose personal information such as a social insurance number by email. U WAGEN will do the same for its part by not responding to questions by email when this involves transmitting confidential data.

Electronic messages are treated with the same confidentiality measures as mail received by post. If the User transmits personal information by email, by completing an unsecured online form or by subscribing to a mailing list, and in this case U WAGEN will conclude that he has given his consent, you should know that :

– the Website will only use the information required to respond to and follow up on the User’s request; – this information is retained, then destroyed, in accordance with the requirements of the Act respecting – access to documents held by public bodies and the protection of personal information; – the information transmitted will in no case be used to establish user profiles; – the Website will transmit this information to another organization only if the request is addressed to it or this communication is required by law; – the Website will not transmit any information to a private organization.

Internally, U WAGEN ensures that it imposes constraints on the rights of use of its information systems so that only employees who must have access to them are authorized to access them. A rule to revoke password access from anyone who leaves the organization, whether a team member, employee or intern, is in place. This revocation must be done within 24 hours of departure. Likewise, access to external suppliers must be revoked once the contract has ended.

Computer equipment is protected by anti-virus software, files encrypted and protected by passwords.

In the case of external service providers, they must sign a confidentiality and non-disclosure agreement with U WAGEN if the tasks to be performed include access to certain personal information during the term of their contract.
These service providers may include, but are not limited to: a social media management company, a web programmer who needs to install a new management system, etc.U WAGEN

This confidentiality and non-disclosure agreement describes the measures that service providers must take to ensure the confidentiality of the personal information encountered, that the use of this information is only made within the framework of the execution of the contract and that they cannot keep this information after it expires.

In addition, this agreement provides that service providers must notify the person responsible for the protection of personal information of U WAGEN (indicated in this Policy) of any violation or attempted violation of the confidentiality obligations concerning the personal information communicated and must allow this manager to carry out any verification relating to this confidentiality.

User rights

The User has the right to access his personal information, to correct it, to delete it, to limit its processing and to withdraw his consent. The User may also object to the processing of their information for direct marketing purposes. To exercise these rights, the User concerned must submit a written request to this effect to the person responsible for the protection of personal information of U WAGEN, at the email address indicated in the following section.

Complaint handling process

Réception: Any User who wishes to make a complaint relating to the application of this Policy or, more generally, to the protection of their personal information by U WAGEN, must do so in writing by contacting the information protection manager personnel of U WAGEN, to the email address indicated in the following section.

The User must indicate his name, his contact details, including a telephone number, as well as the subject and reasons for his complaint, giving sufficient detail so that it can be evaluated by U WAGEN If the complaint made is not sufficiently precise, the person responsible for the protection of personal information may request any additional information that he considers necessary to be able to evaluate the complaint.

Traitement: U WAGEN undertakes to treat any complaint received confidentially, within 30 days following receipt of the complaint OR following receipt of all additional information deemed necessary and required to be able to process it. The person responsible for the protection of personal information must evaluate the complaint and provide a written response by email to the complainant.

Applicable laws

These terms are governed and interpreted in accordance with the laws of the province of Quebec.

U WAGEN may update this Policy from time to time to reflect changes in its privacy practices. U WAGEN will inform the User of any substantial modification, as well as their date of implementation, in the section below.

Data exchanged automatically

By accessing this Website, an exchange of information takes place automatically between the User’s computer and the server which hosts this Website ( PlanetHoster , with a server located in Montreal, Quebec, Canada). View their Terms and Privacy Policy
No information allowing the identity of the User to be known is directly associated with these files. The IP address is sometimes logged. The IP address is considered personal information, since it is an identifier, but can only be linked to a user with the intervention of the provider used.
The information exchanged is as follows:
  • The domain name of the User’s Internet provider (example: videotron.ca) and its IP address (eg: 123.45.67.890). As a general rule, an IP address is a unique number which is assigned to the User by his internet service provider and which allows him to connect to the Internet network and to transmit the information intended for him. This unique number is automatically logged by web servers;
  • The type of browser and operating system used by the User;
  • The date and time the User accesses the Website;
  • The pages consulted and the duration of these consultations;
  • If the User accesses the Website from another site, the address of the latter (referring site).
This exchange of information is required due to the technological requirements inherent to browsing the Internet.
This information is only kept for statistical purposes concerning the Website, in particular to count the number of visitors, the most visited pages, the technology used by visitors, referring sites and the country of origin of Internet users.

Cookie files

Cookies are used to facilitate navigation within the pages of the Website. Cookies are small text files that are downloaded into a User’s Cache memory when viewing the Website. These cookie files do not allow personal information to be collected about the User. The Website uses these cookies to personalize the display of pages, to offer technical features and to collect certain Website usage statistics.
The Website uses cookies in particular:
  • To memorize the User’s settings and preferences, for example for the choice of language and to allow monitoring of the current session;
  • For statistical purposes to know the behavior of visitors, the content consulted and to enable the improvement of the Website.
The Website uses the following types of cookies:
  • Session cookies: These are temporary cookies that are stored for the duration of the Website visit only.
  • Persistent cookies: They are kept on the computer until they expire and they will be retrieved the next time you visit the Website.
Cookies may be necessary or optional. Necessary cookie files must be present for the proper functioning of the Website. If the User refuses these files, he will then have to leave the Website. The User can , however, refuse optional cookies, and continue to browse the Website, by personalizing their preferences or by clicking on I refuse when entering the Website.
The User can at any time configure their browser to block cookie files. However, this action risks depriving him of certain functions offered on this Website and on other sites that he may visit.
If the User uses a computer in a public place or shares a computer with other users, he must ensure that he deletes the traces of his browsing stored in the history before ending each session.

Use of Google Analytics

The Website uses Google Analytics, a website analysis tool provided by Google, to enable its continuous improvement. Using cookies, Google Analytics collects information about Users’ navigation on the Website, for example the pages visited, the date and time of visits and the links that are clicked. It also collects the type of computer operating system, browser language, the name of the User’s Internet service provider and geographic location. The data collected and the anonymized IP address (truncated address) are stored by Google on servers located, notably, in the United States. Google uses this information only to produce statistics and reports on navigation on the Website.

Information from Google Analytics will never be shared by U WAGEN with third parties, unless a web marketing service provider is engaged to improve the performance of the Website. If applicable, this supplier must sign the confidentiality and non-disclosure agreement (see section Security of Personal Information). Please note: IP addresses are anonymized with Google Analytics version 4, so nothing can directly identify the User.

It is possible for the User to install a browser add-on to disable Google Analytics on all sites. The User can choose not to be tracked by Google by customizing their preferences or by clicking on I refuse when entering the Website.

Other technological means used

U WAGEN also collects personal information voluntarily through forms integrated into its Website (for example, the contact form, a form to subscribe to the newsletter, the estimate form). See the Collection of Personal Information section on the Website.
